JOB GOAL

Responsible for managing and monitoring equal employment and educational opportunity activities, and ensuring compliance with applicable local, state, and federal rules and regulations, including the Equal Opportunity Employment Act, Florida Educational Equity Act (FEEA), and Americans with Disabilities Act (ADA).

ESSENTIAL DUTIES & RESPONSIBILITIES

The following statements are intended to describe the general nature and level of work being performed by individuals assigned to this position. These statements are not intended to be construed as an exhaustive list of all duties and responsibilities required of those in this position.
  1. Provide leadership to the District regarding all matters related to equal employment and educational opportunity through an effective system of policy development, implementation, and compliance.
  2. Ensure that District activities are conducted in conformity with all applicable laws, regulations, policies, and procedures.
  3. Facilitate prompt and thorough investigations in response to discrimination, harassment, and other related claims, which includes developing an investigative plan, identifying and interviewing witnesses, gathering and securing information and data, and keeping accurate and thorough records and notes of the investigatory process.
  4. Prepare information for and participate in meetings, hearings, or grievances related to the results of investigations.
  5. Advise and work with other administrators in matters concerning civil rights compliance, equal employment, or educational opportunity issues.
  6. Review requests made by employees, students, and parents for reasonable accommodations under the Americans with Disabilities Act (ADA), and work with the appropriate administrator to respond to such requests.
  7. Coordinate the District’s response to complaints and charges of employment discrimination received through the Equal Employment Opportunity Commission (EEOC) and the Florida Office of Equal Educational Opportunity (OEEO).
  8. Coordinate the District’s response to complaints and charges of educational opportunity discrimination received through the Florida OEEO and the Federal Office of Civil Rights (OCR).
  9. Manage outside counsel in litigation matters and coordinate internal requirements in connection with litigation.
  10. Coordinate, develop, and implement a comprehensive District equity plan and analyze and monitor District practices to ensure compliance is maintained with the District's non-discrimination policy.
  11. Develop and disseminate information regarding policies of non-discrimination and harassment, and equal employment and educational opportunity to applicants, students, parents/guardians, and the public.
  12. Research and write proposals to access additional equal employment and educational opportunity resources.
  13. Develop and maintain positive working relationships with state and federal enforcement agencies responsible for equal employment and educational opportunities.
  14. Provide staff development opportunities for District employees on matters pertaining to discrimination, harassment, and other equal employment and educational opportunity topics.
  15. Coordinate and submit the District’s annual equity program update as required by the Florida Department of Education (FLDOE).
  16. Answer employee, student, and parent/guardian questions regarding discrimination, harassment, and other general equal employment and educational opportunity matters.
  17. Oversee and coordinate the District’s efforts to comply with its obligations under Title IX and the Title IX regulations.
  18. Represent the District on committees and councils related to the job assignment.
  19. Direct and coordinate applicable audits, and prepare reports for local, state, and federal records while maintaining confidentiality in all aspects of work.
  20. Keep up to date on information, laws, regulations, and programs related to equal employment and educational opportunity.
  21. Perform other duties as assigned.

KNOWLEDGE, SKILLS & ABILITIES

  • Comprehensive knowledge of and ability to interpret federal and state nondiscrimination laws, including Title II, Title VI, Title VII, Title IX, ADA, and other related laws and policies
  • Comprehensive knowledge of student and employee disciplinary procedures
  • Ability to read, interpret, and enforce State Board Rules, school board policy, and all applicable laws and regulations in the governing of equal employment and educational opportunity
  • Knowledge of the various levels of the judicial system as it relates to the students and personnel of the District
  • Ability to successfully interact with and address the needs of a diverse community on sensitive topics
  • Ability to communicate effectively with a variety of audiences, orally and in writing, including electronic media
  • Excellent time management skills and ability to organize, prioritize, and manage work assignments in an efficient manner and within established timeframes
  • Ability to work collaboratively with others and facilitate groups to consensus
  • Ability to effectively engage in the problem-solving process
  • Operating knowledge of computer programs, including email, word processing, spreadsheets, databases, and web-based technologies and platforms
  • Ability to establish and maintain collaborative working relationships with all stakeholders

EDUCATION, TRAINING & EXPERIENCE

  • Master’s degree from an accredited institution in the field of Legal Studies, or a related field
  • Three years’ legal experience that includes related education, human resources, employee relations, and/or equal employment and educational opportunity
  • Three years’ experience conducting complaint, incident, and/or grievance investigations of ADA, judicial affairs, discrimination complaints, or related laws, rules, and regulations
  • OR
  • Any satisfactory combination of experience and training which demonstrates the knowledge, skills, and abilities to perform the essential responsibilities

CERTIFICATES, LICENSES & REGISTRATIONS

  • None

PREFERRED QUALIFICATIONS

  • Juris Doctor degree from an accredited institution 
  • Six years' experience in education, human resources, employee relations, and/or equal employment and educational opportunity 
  • Broad knowledge of the roles and responsibilities of District personnel including teachers, administrators, and classified employees 

SUPERVISORY RESPONSIBILITY

Direct supervision of assigned personnel. Responsibilities include planning, assigning, and directing work; addressing complaints and resolving problems; training employees; evaluating performance; and interviewing, testing, hiring, and assignment of personnel.

PHYSICAL REQUIREMENTS

Light Work: Exerting up to 20 pounds of force occasionally and/or up to 10 pounds of force frequently. If the use of arm and/or leg controls requires exertion of forces greater than that for sedentary work and the worker sits most of the time, the job is rated as Light Work.

While performing the duties of this job, the employee is required to sit, talk, and hear; stand and walk; use hands to finger, handle, or feel; reach with hands and arms. The employee occasionally lifts and/or moves up to 25 pounds. Specific vision ability required by this job includes close vision, distance vision, and the ability to adjust focus.

WORKING CONDITIONS

Indoors and Outdoors: The worker is subject to both environmental conditions. Activities occur inside and outside.

TERMS OF EMPLOYMENT

Salary and benefits shall be paid consistent with the District’s approved compensation plan. Length of the work year and hours of employment shall be established by the District.

Performance of the job will be evaluated in accordance with provisions of the School Board’s policy on evaluation of personnel.
